Acceptance of Terms

By accessing or using Sightova ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to:

• Individual users accessing the web application
• Organizations and businesses using our enterprise solutions
• Developers integrating with our API
• Any third party accessing the Service on behalf of a user

Description of Service

Sightova is an AI-powered image detection platform that analyzes images to determine whether they are AI-generated, manipulated, or authentic. Our services include:

• Image Analysis: AI-powered detection of synthetic and manipulated images
• Confidence Scoring: Percentage-based authenticity assessments
• API Access: Programmatic integration for automated workflows
• Batch Processing: Bulk image analysis capabilities
• Reporting: Detailed analysis reports and documentation

User Accounts

Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Account Requirements

• You must be at least 16 years of age to create an account
• Business accounts must be registered by an authorized representative
• One person or entity may not maintain multiple free accounts
• Shared accounts are not permitted unless explicitly authorized for enterprise plans

Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means to access the Service without our express permission (except through our official API)
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Use the Service for any fraudulent or deceptive purposes
• Upload images that violate others' intellectual property or privacy rights
• Upload illegal content, including child exploitation material

API Usage Terms

If you access the Service through our API, the following additional terms apply:

Rate Limits

• API usage is subject to rate limits based on your subscription tier
• Exceeding rate limits may result in temporary throttling or suspension
• Rate limit increases must be requested and approved in advance

API Keys

• API keys are confidential and must be kept secure
• You are responsible for all activity associated with your API keys
• Compromised keys must be regenerated immediately
• Sharing API keys is prohibited unless explicitly authorized

Attribution

Applications using our API must include appropriate attribution to Sightova unless you have a specific agreement stating otherwise. Attribution guidelines are available in our API documentation.

Intellectual Property

Our Intellectual Property

The Service and its original content, features, and functionality are owned by Sightova Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes:

• The Sightova name, logo, and branding
• Our AI models and detection algorithms
• The website design and user interface
• Documentation, tutorials, and educational content
• API specifications and developer tools

Your Content

You retain all rights to images and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service. As stated in our Privacy Policy, uploaded images are processed and immediately deleted.

You represent and warrant that you own or have the necessary rights to all content you upload and that such content does not infringe on any third party's rights.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
• SIGHTOVA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
• SIGHTOVA DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DETECTION RESULTS.
• IN NO EVENT SHALL SIGHTOVA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SIGHTOVA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Sightova Inc., its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Content you upload or submit to the Service
• Your violation of any third-party rights
• Any misrepresentation made by you

Termination

Termination by You

You may terminate your account at any time by contacting us or using the account settings. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of the Acceptable Use Policy
• Non-payment of fees
• Suspected fraudulent or illegal activity
• Extended periods of inactivity

Effect of Termination

Upon termination, all licenses and rights granted to you will immediately cease. Sections that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

Notwithstanding the foregoing, Sightova may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were last revised.
